On July 1, 2024, the Division of Health Improvement was transitioned from the Department of Health to the newly established Health Care Authority per SB14 NM State legislature 2023 session. As part of that transfer the new Health Care Authority(HCA) repealed and replaced multiple rules transferring the authority to the newly established HCA. During that process an error was made in promulgating 8.370.3 Health Facility Licensure Fees and Procedures, repealing 7.1.7.NMAC. Unfortunately, the wrong rule was published. This emergency rule repeals the rule in error and replaces it with the correct rule for 8.370.3 NMAC.
