Behavioral Health Reform and Investment Act (BHRIA)
Senate Bill 3 (SB3) 2025
Senate Bill 3 (2025) passed with strong bipartisan support during the 2025 legislative session, enacting the Behavioral Health Reform and Investment Act. This law was a major step in reforming New Mexico’s behavioral healthcare system, including significant changes to how behavioral health and substance use treatment programs are managed statewide.
The behavioral health reform and Investment Act took a regional approach to behavioral health care. On June 24, 13 behavioral health regions were established by the Administrative Office of the Courts (AOC). Each region has the opportunity to identify up to five behavioral health priorities and request funding to implement a four-year plan.
The goal of this new structure is to incorporate all three branches of the government and bring stakeholders to the table to strengthen the behavioral health care system in New Mexico.
Through the passing of SB3 2025, the New Mexico Behavioral Health Collaborative was officially sunset on June 20, 2025.
Behavioral Health Regional Plans
Each Behavioral Health Region in New Mexico plays a central role in shaping service improvements and investments throughout our state. These Regional Plans are your opportunity to define what your communities need most, highlighting the strengths and gaps in your local system, and outlining the strategies that will drive meaningful change
Behavioral Health regional plans will guide statewide funding decisions and help ensure that resources are aligned with the priorities identified by the people closest to the work. Your regional insights, partnerships, and on‑the‑ground experience are essential to building a behavioral health system that is responsive, coordinated, and sustainable.
Each behavioral health region is given the opportunity to submit a four‑year plan that includes:

- Up to five priority areas informed by local data, community engagement, and stakeholder collaboration
- Proposed strategies and initiatives to address those priorities
- Funding requests tied to clear goals and expected outcomes
- A framework for tracking progress and demonstrating impact
The Regional Plans serve as the foundation for statewide investment and accountability. By articulating your region’s vision and needs, you help shape a stronger, more connected behavioral health system for all New Mexicans.
Behavioral Health Regional Planning Accountable Entities:
An Accountable Entity is a government, nation, pueblo, tribe, or quasi-government entity within a Behavioral Health Region, who will serve as the regional representative within the proposed plan, and will serve as the fiscal agent of that region.
The Administrative Office of the Courts is working with each regional Accountable Entity to help coordinate regional planning efforts including, convening partners and stakeholders, ensuring alignment between identified behavioral health priorities, proposed strategies, and funding requests.

Standards and Guidelines
As outlined in SB3, the New Mexico Health Care Authority, in consultation with other state agencies, was tasked with providing the Administrative Office of the Courts with an initial set of generally recognized Behavioral Health Service Standards and Evaluation Guidelines by June 1, 2025. These Service Standards and Evaluation Guidelines shall be used and referenced when determining whether each regional plan meets the standards, set forth by the Behavioral Health Reform and Investment Act.

Evaluation Guidelines
As outlined in SB3, the Legislative Finance Committee and the New Mexico Health Care Authority was tasked with providing the Administrative Office of the Courts with an initial set of Evaluation guidelines by June 1, 2025.
The evaluation guidelines include methods for evaluating the effectiveness of promising practices and behavioral health services. The Health Care Authority, in consultation with the Legislative Finance Committee, shall confirm if each behavioral health service in a regional plan meets the evaluation guidelines.

Early Access Regional Plans
To accelerate access to critical care while regional behavioral health plans are being developed, the New Mexico Health Care Authority (HCA) has issued a Notice of Funding Opportunity for Early Access Regional Funding. Up to $26 million will be awarded statewide to address four critical behavioral health access shortages: residential treatment, crisis services, medication-assisted treatment for justice-involved individuals, and prenatal and perinatal substance use disorder treatment.
Applications are open at newmexicohsd.bonfirehub.com/opportunities/208928. Applications are open through December 19, 2025, with awards to be announced the week of January 26, 2026. This early access funding bridges the gap between planning and implementation—ensuring communities can deliver timely, life-saving care while building toward long-term regional reform.

Behavioral Health Executive Committee Meetings
Senate Bill 3 is a transformative policy aimed at rebuilding New Mexico’s behavioral health and substance use care systems. It creates a statewide framework for collaboration, regional planning, and sustained investment to ensure all New Mexicans have access to timely, quality behavioral health care.
